Khieu Samphan Seeks Release Via Judges

Defense lawyers for jailed Khmer Rouge president Khieu Samphan said Friday they had decided to drop an appeal against his pre-trial detention through the Pre-Trial Chamber, asking instead investigating judges to drop an order to hold their client.

"We think that if we appeal, there is no hope," lawyer Sa Savan said. "Then we came back and asked the co-investigating judges to reconsider the provisional release of Khieu Samphan."

In a discussion in his cell with investigating judges Thursday, Khieu Samphan said he wanted to be released, Sa Savan said.

Investigating judges have the power to rescind their detention order, an order that the Pre-Trial Chamber has the power to overrule.

Co-investigating judge You Bunleng said Friday he and his international counterpart were waiting for five days to hear from prosecutors before deciding on the request.

Khieu Samphan, former nominal head of the regime, was arrested Nov. 19, 2007, and is charged with war crimes and crimes against humanity.

Delayed proceedings have meant Khieu Samphan has been held too long, especially considering his poor health, his lawyers said in a statement to the courts.

The demand for Khieu Samphan's release comes as the tribunal continues to fight allegations of corruption.

The court monitoring Open Society for Justice Initiative urged donors this week to condition future funding on a clean-up of corruption, following allegations by Cambodian staff they were forced to pay kickbacks.

Rights Leader Regrets Loss of UN Envoy

For the first time since the Paris Peace Accords, Cambodia will not have a UN human rights envoy from the secretary-general, but will instead have a rapporteur assigned by the UN Human Rights Council.

Kek Galabru, a leading human rights activist in Cambodia who founded the group Licadho, said she "regretted very much" the change.

"We still see the UN human rights envoy as being able to help promote human rights in Cambodia," she said Thursday, as a guest on "Hello VOA."

Former rights representatives of the UN secretary-general have been unbiased in their reporting, she said.

This reporting has sometimes led to a strain on relations between the UN and Cambodia, especially with the previous envoy, Yash Ghai, who resigned earlier this year.

Kek Galabru said the Paris Peace Accords required an envoy from the secretary-general, but on Sept. 24, the Human Rights Council chose instead a posting for rapporteur. This will make a difference, she said, because the rapporeur will not report directly to the secretary-general.

Om Yentieng, head of the government's human rights committee, said in a recorded statement Ghai had made inaccurate reports on Cambodia.

Om Yentieng declined to comment on the current human rights situation in Cambodia, leaving it to "third parties" in order to avoid sounding "proud."

First Khmer Rouge Trial Inches Nearer

Khmer Rouge tribunal officials announced Thursday they would determine a trial date for jailed prison chief Duch in January, setting the firmest date yet for the first trial of five jailed leaders.

In a statement Thursday, tribunal officials said the trial date for Duch, whose real name is Kaing Kek Iev, will be decided after the Pre-Trial Chamber rules on an indictment appeal by prosecutors on Dec. 5.

Prosecutors appealed a ruling by investigating judges in August, claiming the indictment had not encompassed the full extent of his alleged crimes. A ruling on that appeal will move a trial forward, though no date is certain.

“We cannot expect any date before the Pre-Trial Chamber decides on the appeal,” tribunal spokesman Reach Sambath said.

However, Long Panhavuth, a program officer for court monitor for the Open Society for Justice Initiative, said he expected a trial for Duch would not start until at least February 2009.

Duch, 65, charged with war crimes and crimes against humanity, has been detained since May 1999. Four other Khmer Rouge leaders were arrested in 2007.

“Successfully conducting trials of this significance is a complex process, and the Court recognizes that it can be frustrating for the millions who have been waiting for decades to see justice done,” the tribunal said in its statement Thursday. “Nevertheless, each step of the legal process must be followed carefully and conducted in line with the highest standards of justice. This will also ensure the most enduring legacy for the Cambodian Courts.”

The announcement came as three senior-most detained leaders were sent to the hospital for check-ups. Nuon Chea, 82, Khieu Samphan, 76, and Ieng Sary, 82, each were taken to Calmette Hospital for routine visits this week.

Poor To Receive Emergency Aid Package

The Asian Development Bank assistance would provide free rice to certain families living in poverty, as well as seeds and fertilizer to farmers.

The Asia Development Bank said Wednesday it would provide $35 million in emergency food aid to counter rising food and fuel prices gripping the country.

The aid would go to families living in seven provinces around the Tonle Sap lake and in the slums of Phnom Penh, the ADB said in a statement.

Half the aid package would be a grant and the other half would be a loan, with the government putting $5 million into the projects, the ADB said.

"There will be funding for food distribution and food for work, and capacity-building for emergency response to the food crisis," Arjun Goswami, ADB's Cambodia director, told reporters Wednesday.

Poor families will be offered free rice and other food subsidies, while schoolchildren will receive food as well. The aid will also be used to foster employment through "food-for-work programs" as well as donations of seed and fertilizer.

"The project will prepare the system to respond to a food crisis," said Vong Sandap, secretary-general of the Ministry of Economy and Finance and director of Cambodia's emergency food assistance project.

A typical Cambodian household spends 60 percent of its income on food, the ADB said, adding that many impoverished families "are selling their household assets and taking out high interest loans in order to purchase food, fueling a downward spiral of poverty."

Development of any site should be well organized in advance and include the participation of local people, a UN expert said Monday, which was World Habitat Day.

Cambodia has seen a huge influx of development projects, leading to the displacement of thousands of people, many of them unwillingly.

In some cases, those who are moved from an urban site have been living there illegally.

But Din Somethearith, the UN's World Habitat program manager in Cambodia, said Monday people should be considered during the plans of development, whether they occupy a space legally or not.

"There should be a good understanding, if you want to development a place, whether it will be in the interest of the people or the economy, whether people are living there illegally or legally, whether those people are supplemental for the growth of the economy or not," he said, as a guest on "Hello VOA."

Officials should not dismiss illegal residents out of hand, he said, as they also support the economy. Many people wish to live in urban areas because it provides a place for business, but by moving them out of town, a common practice across Phnom Penh development projects, a city loses their support.

Meanwhile, residents of a proposed development should be warned five years in advance, with opportunity for long discussions and problem-solving well ahead of time, Din Somethearith said.

The UN World Habitat project promotes higher living standards in Cambodia through partnership with the national government and local authorities.

As Cambodia experiences a construction boom, construction workers and other laborers should know they have rights to leave, medical treatment and other basic rights, two officials said Thursday.

While Cambodia’s labor sector has a robust union tradition, with workers able to collectivize against perceived unfairness, many laborers desperate for work, earning about $5 a day, may overlook their basic rights.

Cambodian law places the responsibility for workers' safety on companies that hire them.

“The companies have to pay workers in accordance with the law,” said Tun Sophorn, Cambodia coordinator for the International Labor Organization, as a guest on “Hello VOA.”

Yi Kanitha, deputy director of the occupational health department at the Ministry of Labor, agreed.

When workers are hurt, “we go and investigate the seriousness of the accidents, what the cause is, and then we evaluate before making a decision on how much the company has to pay,” he said, also as a guest on “Hello VOA.”

Workers should call on the office of occupational health in every province or the capital if they need help, he said.

Thais Turned Back Near Ta Moan Temples

Cambodian soldiers turned back 20 Thai soldiers who had crossed into Cambodian territory in Oddar Meanchey province Wednesday, a military official said.

The Thai soldiers were found near a waterfall about 1.5 kilometers from the Ta Moan temple complex, which has become a second point of contention in an ongoing border dispute, said Col. Nak Vong, deputy commander of Regiment 42, which is stationed in the area.

The soldiers encountered each other at around 10 am, and no shots were fired. The encounter occurred following a brief gunfight at Preah Vihear temple on Friday and the injuries by landmine of two Thai soldiers on Phnom Trop, near Preah Vihear temple, on Monday.

Oddar Meanchey Governor Pich Sokhen said the encounter was a "simple problem," and many similar incidents had occurred since a build-up of troops began July 15.

Cambodia and Thailand have been unable to solve a military build-up that began following Preah Vihear temple's inscription on a Unesco World Heritage protection list July 7.

Prime Minister Hun Sen and Thai Prime Minister Somchai Wongsawat are still expected to meet Oct. 13, despite a Thai political crisis that devolved into violence in Bangkok Tuesday.

· នៅឆ្នាំ១៩២៥ ប្រទេសបារាំង និងសៀម ចុះហត្ថលេខាលើសន្ធិសញ្ញាមិត្តភាពមួយ។ មាត្រា២នៃសន្ធិសញ្ញានេះបញ្ជាក់ថា«ភាគីចុះហត្ថលេខាទាំងពីរទទួល ស្គាល់ដោយគោរពគ្នាទៅវិញទៅមក ពីព្រំដែននៅលើទឹកដីពួកគេ គឺដោយយោងតាម និងស្របតាមសេចក្តីមានចែងនៅក្នុងកិច្ចព្រមព្រៀងមុនៗ»។
· នៅឆ្នាំ១៩២៦ អនុសញ្ញាស្តីពីទន្លេមេគង្គ អះអាងបញ្ជាក់ម្តងទៀតពីមាត្រា២នៃសន្ធិសញ្ញាឆ្នាំ១៩២៥។
· នៅឆ្នាំ១៩៣៧ សន្ធិសញ្ញាមិត្តភាពថ្មីមួយ លើកមកនិយាយម្តងទៀតនូវបទបញ្ញត្តិនៅក្នុងសន្ធិសញ្ញាឆ្នាំ១៩២៥ ទាក់ទងនឹងបញ្ហាព្រំដែន។

· នៅខែកក្កដា ឆ្នាំ១៩៦២ ប្រទេសថៃព្រមទទួលយកសេចក្តីសម្រេចរបស់តុលាការយុត្តិធម៌អន្តរជាតិ ហើយមិនបានធ្វើបណ្តឹងឧទ្ធរណ៍ទេរយៈពេល៦ឆ្នាំបន្តមកទៀត ដែលក្នុងអំឡុងពេលនេះ ខ្លួនអាចប្តឹងជំទាស់នឹងសេចក្តីសម្រេចនេះបាន។

Three European scientists who discovered the viruses behind AIDS and cervical cancer shared this year's Nobel prize for medicine. Lisa Bryant has more on the prestigious award for VOA from Paris.

The Nobel medicine award was handed to two French scientists: Francoise Barre-Sinoussi and Luc Montagnier - for their discovery of HIV, the virus leading to AIDS, which has killed at least 25 million people worldwide. Another 33 million others are living with the deadly virus.

German doctor and researcher Harald zur Hausen shared the $1.4 prize for his work on cervical cancer, which poses a major threat to women.

Contacted by France-Info radio in Cambodia, Barre-Sinoussi said she was delighted by the news.

Barre-Sinoussi said being awarded the Nobel was an enormous surprise. She acknowledged her discovery was important, given the extent of the epidemic.

Alice Dautry, the head of the Pasteur Institute in Paris where Barre-Sinoussi works, told French radio she was moved and overjoyed by the award after watching the institute's AIDS researchers battle for years for a breakthrough on the virus research.

The medicine prize is the first of six Nobel awards that will be announced during the next week.

Anti-Government Protesters Blockade Thai Parliament Despite Police Intervention

Thailand's government faces an escalating crisis after police repeatedly fired tear gas to break up protesters blockading the parliament building. The clashes led to the resignation of a deputy prime minister. As Ron Corben reports from Bangkok, the strife sets back efforts by Prime Minister Somchai Wongsawat to defuse months of anti-government protests.

The violence in Bangkok erupted early Tuesday when riot police using tear gas and stun bombs to clear anti-government demonstrators who had barricaded themselves outside the parliament building.

The protesters, led by the People's Alliance for Democracy, unsuccessfully tried to prevent Prime Minister Somchai Wongsawat from making his maiden policy speech.

Police and protesters clashed several times during the day, and nearby hospitals reported more than 100 people were admitted with injuries.

A doctor at the Ramathibodi Hospital says emergency wards are on high alert.

"We are prepared for mass casualty in the hospitals around about three to five hospitals around this area ... bomb or just eye [tear] gas," said the doctor.

PAD supporters, angry over the arrest of two of their leaders, vow to continue their blockade until the government quits.

Deputy Prime Minister Chavalit Yongchaiyudh resigned to take responsibility for Tuesday's clashes. He had been working to negotiate an end to the PAD siege of the prime minister's office building.

Protesters accuse Mr. Somchai's government of acting as a proxy for deposed Prime Minister Thaksin Shinawatra. He now lives in Britain, having fled in August to avoid corruption charges. PAD supporters accuse Mr. Thaksin of being corrupt and authoritarian.

A protester named Sam, was among thousands calling for the government to resign.

"The people do not accept this government, so what we ask for, we ask for real democracy not a government of Mr. Thaksin Shinawatra … and this prime minister is the brother-in-law of Thaksin Shinawatra," he said.

Other protesters accuse of the government of seeking to undermine the country's revered monarchy. Wannnisayanam says more people are coming to join the protests despite the clashes with police.

"We've been here for the king - our king. We are not going to let anybody destroy democracy - you see how many people that are coming here," said Wannnisayanam.

The PAD leadership wants to prevent Mr. Somchai's government from passing constitutional amendments that critics say favor Mr. Thaksin. However, the PAD wants to rewrite the constitution so that most members of parliament will be selected by elite groups such as business owners.

Sunai Pasuk, a spokesman for Human Rights Watch's Thai office, says the PAD appears to hope to trigger a military intervention.

"This is a situation where the PAD can conveniently pressure the military to take sides.… It is clear that the crackdown can be categorized as excessive use of violence by security forces and the action of the police today can be directly linked to the policy of Prime Minister Somchai," he said.

In his policy speech Tuesday, Mr. Somchai called for national reconciliation, and said his government is determined to tackle economic problems the country faces.

Thai Parliament Elects Somchai Prime Minister

Thailand's parliament approved the candidate from the People Power Party, Somchai Wongsawat, to be the next prime minister. As Ron Corben reports from Bangkok, Mr. Somchai says national reconciliation will be his priority, after weeks of anti-government protests.

House speaker Chai Chidchob announced the results of Wednesday's parliament vote for prime minister. Chai says Mr. Somchai was backed by 298 lawmakers in the House of Representatives.

Mr. Somchai has been acting prime minister since last week, when Samak Sundaravej was forced to step aside after a court found him guilty of a conflict of interest. Both men are members of the People Power Party, which leads the six-party coalition government.

Mr. Somchai's supporters cheered their candidate outside the parliament before the vote.

The long-time senior bureaucrat takes up the reins with Thai society deeply polarized between supporters of his brother-in-law, former Prime Minister Thaksin, and those who oppose him. Mr. Thaksin's critics accuse him of being corrupt and authoritarian, and say the PPP-led government acts on his behalf.

Mr. Thaksin, who led his allies to two national election victories, was ousted in a coup in 2006. He fled to Britain last month during his trial on corruption. His supporters are chiefly the poor and rural residents, while most of his critics are from wealthier urban areas.

The People's Alliance for Democracy leads the opposition. Thousands of PAD supporters have camped outside the main government administration building for weeks. Originally they called for Mr. Samak's resignation, but now they vow to continue their blockade until the PPP is out of power.

PPP spokesman Kudeb Saikrajang says Mr. Somchai's first task is to ease political tensions.

"The party has made it clear to the public that the most important task for us is to promote reconciliation - or what we call national reconciliation - to bring back unity to the country and to assure the public that the PPP will avoid confrontation with any group of people in the society," said Kudeb.

Buranaj Samutharak, a spokesman for the opposition Democrats, says his party will watch to see whether the government allows corruption cases against Mr. Thaksin to proceed and whether it pursues unpopular constitutional changes.

"We'll have to wait and see whether the government succeeds in addressing some of the main concerns of the people which have led to the present state of political crisis," said Buranaj.

Some political analysts say Mr. Somchai, who is known for his gentlemanly manner, may not be able to ease tensions. If not, they say the crisis could continue until there are new elections, or something else, such as a military coup, changes the government.

Also on Wednesday, a Thai court postponed issuing the verdict in a corruption case against Mr. Thaksin. Instead, the court issued new arrest warrants for him and his wife and set a new hearing date for October 21.

Thailand protests Cambodian border incursion

The foreign ministry on Saturday issued an official protest to the Cambodian government over an alleged border incursion and subsequent clash that left three soldiers injured, Thai officials said Saturday.

On Friday a Thai military patrol encountered Cambodian troops allegedly situated about one kilometre inside Thai territory near the Phreah Vihear temple.

"According to the Thai military the Cambodians were definitely inside Thai territory, and the Cambodian side opened fire first," said foreign ministry spokesman Tharit Charungvat.

Two Thai soldiers and one Cambodian were wounded in the brief firefight on the border.

The foreign ministry's permanent secretary Virsakdi Footrakul plans to submit a formal letter of protest to the Cambodian charge d'affaires in Bangkok over the incident at 5 p.m. Saturday, said Tharit.

Both countries claim a 4.6-square-kilometre plot of land adjoining the temple.

The spat escalated from a diplomatic row to a potential military conflict in mid-July when three Thais were detained for entering the disputed temple territory, and both sides dispatched military troops to the area. (dpa)

Cambodian and Thai troops suffered injuries during an exchange of gunfire Friday afternoon near Preah Vihear temple, in the first real military fighting of the prolonged border standoff, say Cambodian officials.

"One Cambodian was shot in the arm, and we believe one or two Thai soldiers were injured," according to Yim Phim, the commander of brigade 43, which is stationed in the area.

He said the incident started at around 3:00pm when about a dozen Thai soldiers approached a Cambodian army encampment at Phnom Troap, just a couple kilometres from the World-Heritage listed temple, and demanded troops there leave.

"They showed them a Thai-made map and told the Cambodians to get off the land. An argument went on for a while," said Yim Phim. "The Thais then withdrew about ten meters and started firing."

"Thai soldiers first fired an M-79 (grenade launcher), and Cambodians shot back with a B-40 (grenade launcher). Then both sides fired with machine guns," he said.

He said the Thai soldiers withdrew across the border after dark, around 5:30, while the Cambodian soldiers remained in their original position.

"In that area, soldiers from both countries used to stay close to each other, but the situation has changed and now everyone is on high alert."

Srey Doek, the highest-ranking military official stationed inside the Preah Vihear temple complex, told the Post Saturday morning that his Thai counterpart had requested to meet him Saturday afternoon in the local pagoda, but he still did not have authority from his superiors to attend.

Cambodian government and army leaders have thrown a wet blanket on the first reported violent military clash since the standoff began more than 11 weeks ago, characterizing it as a localized incident that would not threaten to spread to other points along the border.

Chea Morn, head commander of Military Region 4, which includes Preah Vihear province, corroborated that "a clash", as described by the brigade commander, had taken place, but said it was "just a small problem... and would be resolved."

Council of Ministers spokesman Phay Siphan said the Cambodian Ministry of Foreign Affairs would contact its Thai counterpart to discuss to incident, but called it "a problem between the soldiers stationed in that area... and not a problem between the governments."

"The government's position is still that diplomatic negotiations must be used to solve this dispute."

Just earlier this week, in the sidelines of the UN General Assembly summit in New York, top foreign affairs officials from both sides reiterated the commitment of their governments to resolving the dispute peacefully.

Phay Siphan said talks between the Cambodian and Thai prime ministers on October 13 in Phnom Penh would proceed as planned.

At least one Cambodian soldier was injured Friday afternoon in an exchange of gunfire between Thai and Cambodian troops near the Preah Vihear provincial border, in the first reported act of military violence in a prolonged standoff, a military official said.

Thai soldiers fired a grenade at a group of Cambodian soldiers, injuring a Cambodian in the leg, while a Thai soldier was wounded in the abdomen in the return gunfire, according to a reliable military officer in the area, who asked not to be named due to the sensitivity of the issue.

"At 3:35 pm, around 10 [Thai soldiers] entered the Cambodian position, and Cambodian soldiers called to them not to enter, and they did not listen," the officer said. "And then they shot with the M-79 [grenade]."

The soldiers were nearly 200 meters from the Cambodian position on Phnom Troap, more than 1 kilometer from the Preah Vihear temple complex, the officer said.

Government spokesman Khieu Kanharith told the Associated Press the Cambodian was “slightly wounded” when Thai troops fired an M-79 grenade from their own territory. Khieu Kanharith confirmed the Cambodian side had returned fire, AP reported.

A report from Ministry of Defense information office obtained by VOA Khmer Friday coroborrated the statements of the military officer and said both sides remained at a standoff at 5 pm.

The exchange of violence, which lasted only moments, was the first reported in an 11-week military standoff over Preah Vihear temple. Officials had cautioned that prolonged proximity between the troops could end in bloodshed.

Both Cambodian and Thai officials have said they are committed to peaceful resolution of the impasse, which began following the inscription of the temple, which abuts a disputed border area, onto a Unesco World Heritage list in July.

Defense Minister Tea Banh could not be reached for comment, and a person answering the phone of the Thai Embassy's first secretary said he was unavailable.
